Section 49 of the CPA provides that a provision in an agreement that persons who rent their homes place a considerable degree of trust in their owners. Tenants are at a significant disadvantage in their principled relationship with a landlord, as the landlord has some power to make their home uninhabitable or make it homeless. Some provisions of the state`s owner-tenant law, much like the Consumer Protection Act, address this imbalance. These include the obligation for a landlord to make appropriate repairs to a rental matter and the obligation to obtain appropriate redress before a tenant is evicted or otherwise excluded from the property. .
